These Terms and Conditions ("Terms") govern your access to and use of the NetShine ONE platform, website at www.netshine.one, and any related services (collectively, the "Platform") operated by NetShine Technologies Pvt. Ltd. ("NetShine", "we", "us", "our"), a company incorporated under the Companies Act, 2013, India.
By accessing or using the Platform — including signing up for an account, submitting an enquiry form, or using any NetShine service — you ("Customer", "you") agree to be bound by these Terms. If you are using the Platform on behalf of a hotel, resort, restaurant, or business entity, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, please do not use the Platform.
NetShine ONE is a Software-as-a-Service (SaaS) hospitality operating platform. Depending on your subscription plan, this may include:

To use the Platform, you must create an account. You agree to:
You must be at least 18 years old and legally capable of entering into a binding contract to create an account. By registering, you confirm you meet these requirements.
Subscription plans: NetShine ONE is offered on a subscription basis — monthly or annual depending on the plan selected. The features, pricing, and billing cycle applicable to your subscription are described on our pricing page and in your order confirmation.
Payment: Payments are processed securely through Razorpay or other designated payment gateways. By providing payment details, you authorise NetShine to charge the applicable fees on the billing cycle you have selected. All prices are in Indian Rupees (INR) unless stated otherwise, and are exclusive of applicable GST.
GST: GST will be applied to all invoices at the rate applicable under Indian law at the time of billing. GST invoices will be issued in accordance with the GST Act.
Auto-renewal: Subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date. You will receive a reminder email before renewal. To cancel auto-renewal, contact us at hello@netshine.one or through your account settings.
Refunds: Annual subscription fees are non-refundable once paid, except where required by Indian consumer protection law. Monthly subscriptions are not refunded for partial months. If you have been incorrectly charged, contact us within 30 days and we will investigate and refund where applicable.
Overdue payments: If a payment fails, we will attempt to notify you and retry the charge. Access to the Platform may be suspended if fees remain unpaid for more than 15 days after the due date.
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:
We reserve the right to suspend or terminate accounts that violate these acceptable use rules without prior notice and without refund.
Your data: You retain full ownership of all guest data, reservation data, and business data you upload to the Platform. NetShine processes this data only to provide you with the Platform services, as described in our Privacy Policy.
Data export: You can request an export of your data at any time by contacting our support team. Upon termination of your subscription, we will retain your data for 90 days, during which you may request an export. After 90 days, your data will be permanently deleted from our systems, except where we are legally required to retain certain records.
Platform improvements: We may use anonymised, aggregated usage data (not linked to your identity or your guests) to improve the Platform, develop new features, and generate industry insights.
The Platform, including its software, design, features, content, trademarks, and branding, is owned by NetShine Technologies Pvt. Ltd. and protected by applicable Indian intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your internal business purposes during the subscription period. This licence does not include any right to copy, modify, distribute, or create derivative works based on the Platform.
Any feedback, suggestions, or ideas you provide about the Platform may be used by us to improve our products without any obligation to compensate you.
We aim to maintain the Platform with a target uptime of 99.5% per month, excluding scheduled maintenance windows. Scheduled maintenance will be communicated in advance where possible.
We do not guarantee that the Platform will be error-free, uninterrupted, or available at all times. Downtime caused by internet connectivity issues, third-party service failures (OTAs, payment gateways, cloud infrastructure), force majeure events, or factors outside our reasonable control is excluded from uptime calculations.
In case of significant unplanned outages affecting your operations, please contact our support team at hello@netshine.one. We will acknowledge all support requests within 24 hours on business days.
The Platform may integrate with third-party services including OTAs (MakeMyTrip, Goibibo, Booking.com, Agoda), payment gateways (Razorpay), and other hospitality systems. These integrations are provided as a convenience and NetShine is not responsible for the availability, accuracy, pricing, or policies of third-party platforms.
Your use of third-party integrations is subject to the terms and conditions of those third-party providers. NetShine is not liable for losses arising from third-party service failures, OTA policy changes, or payment gateway errors.
To the maximum extent permitted under applicable Indian law:
Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under Indian law.
You agree to indemnify and hold harmless NetShine Technologies Pvt. Ltd., its directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
By you: You may terminate your subscription at any time by contacting us at hello@netshine.one. Termination takes effect at the end of your current billing cycle. No refund is issued for unused time within a paid billing cycle.
By us: We may suspend or terminate your account immediately, without prior notice, if you:
Upon termination for any reason, your right to access the Platform ceases immediately. We will retain your data for 90 days post-termination to allow you to export it.
We may update these Terms from time to time to reflect changes in our services, business practices, or applicable law. When we make material changes, we will:
Your continued use of the Platform after the effective date of updated Terms constitutes acceptance of the revised Terms. If you do not agree with the changes, you may terminate your subscription before they take effect.
These Terms are governed by and construed in accordance with the laws of India, including but not limited to the Information Technology Act 2000, the Digital Personal Data Protection Act 2023, the Indian Contract Act 1872, and the Consumer Protection Act 2019.
Dispute resolution: In the event of any dispute arising from these Terms or your use of the Platform, the parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Dehradun, Uttarakhand, India.
The courts at Dehradun, Uttarakhand shall have exclusive jurisdiction over any matters not subject to arbitration.
